АННОТАЦИЯ
Статья посвящена одному из важнейших институтов административного права — административному расследованию, инновационные нормы которого рассмотрены сквозь призму правоприменения. В результате анализа действующего законодательства и судебной практики авторы приходят к выводу, что без оптимизации правовых норм, регламентирующих условия проведения административного расследования, невозможно вести речь о соблюдении законности при осуществлении производства по делам об административных правонарушениях.
ABSTRACT
The article is devoted to one of the most important institutions of administrative law — administrative investigations, innovative rules which are considered through the prism of law enforcement. An analysis of the current legislation and judicial practice, the authors concluded that without optimization legal rules governing the conditions of an administrative investigation, it is impossible to talk about the rule of law in the exercise of proceedings on administrative violations.
